I.        Accessing the Website means you agree to these Terms of Use 

These Terms of Use are a legal agreement between you, the end user, and Mary’s Center for Maternal and Childcare, Inc. acting on behalf of its subsidiaries, affiliates, and licensors, (“Mary’s Center”), and governs your use and access to the Mary’s Center Website. 

Except where expressly noted otherwise, the Mary’s Center Website consists of all websites located on the following root domains: https://www.maryscenter.org/ (the “Website”).  

By your access and use of the Website, you are indicating that you agree to these Terms of Use. IF YOU DO NOT AGREE WITH THESE TERMS OF USE, DO NOT ACCESS OR USE THE WEBSITE. In addition, you may be required to acknowledge your consent to these Terms of Use or third-party terms of use to navigate to certain pages of our Website or to complete some transactions.  

The terms of the Mary’s Center Privacy Policy, available here, and the Notice of Privacy Practices, available here, apply to your use of the Website and are hereby incorporated. The Privacy Policy tells you how Mary’s Center collects, uses, protects, shares, and controls information about you related to your interaction with the Website. Additionally, each affiliate of Mary’s Center that provides healthcare services maintains a Notice of Privacy Practices (“NPP”).  The NPP provides information about how the applicable Mary’s Center affiliate might use and disclose your protected health information (“PHI”). 

II.        The Website is for your noncommercial, personal use 

Mary’s Center makes the Website, including all information, documents, communications, and audio/visual files provided by Mary’s Center or other third parties Mary’s Center licenses content from (collectively, “Materials”) available for your noncommercial, personal use. 

III.        These Terms of Use may change 

From time to time, Mary’s Center may change these Terms of Use at its sole discretion. You should check the Terms of Use periodically. If you do not agree with the revised Terms of Use, do not continue to use the Website. Accessing or using the Website means that you have accepted any changes to these Terms of Use. 

IV.        Third-party Websites and Third Party Pages have different terms of use and policies 

The Website may produce automated search results or otherwise link you to other websites on the Internet. These other websites are not under the control of Mary’s Center, and you acknowledge that Mary’s Center is not responsible for the accuracy, content, privacy policies, terms of use, products, services, legality, reliability, viewpoint, accuracy, currency, copyright compliance, decency or any other aspect of the content of such websites. The inclusion of such a link does not imply endorsement of the linked website by Mary’s Center or any association with its operators. Except for information, products, services, or merchandise identified as being supplied by Mary’s Center, Mary’s Center does not operate, control, supply, endorse, warrant, or guarantee any information, products, services, or merchandise available on this Website or through the Internet generally in any way. 

It is important to understand that when you access or use these other websites, the terms governing your use of other websites may be different from Mary’s Center’s Terms of Use, Privacy Policy, and NPP. If you visit another website, you are encouraged to examine the privacy policies and/or terms of use policies of that website.  

Some portions of the Website are provided in cooperation with third parties (“Third Party Pages”) or are provided by third parties (“Third Party Websites”) and as a result have terms of use that are different from Mary’s Center Terms of Use, Privacy Policy, and NPP, as applicable. When visiting a Third Party Website, your access and use may be subject to additional terms of use.  

V.        Some material on the Website is advertising material 

Mary’s Center is a healthcare provider and as such strives to meet the needs of the community through coordination with other healthcare providers serving in the community. Information regarding our medical staff and other care providers may be available via the Website.

VI.        Disclaimer of warranties

UNLESS EXPRESSLY STATED OTHERWISE, NOTHING CONTAINED IN OR PROVIDED THROUGH THE WEBSITE, INCLUDING ALL MATERIALS, IS OR IS INTENDED TO BE USED FOR MEDICAL DIAGNOSIS OR TREATMENT, OR RELIED ON AS AN ENDORSEMENT BY MARY’S CENTER OF THE MATERIALS. IT SHOULD NOT BE USED IN PLACE OF A VISIT, CALL, CONSULTATION, OR THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROVIDER. Mary’s Center assumes no responsibility for any loss or harm that occurs from your use of the Website.  

Your use of the Website is solely at your risk. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply to you.

VII.        Mary’s Center’s liability is limited 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL MARY’S CENTER, ITS AGENTS, SUBSIDIARIES, OR ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, EXEMPLARY, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, FEES, FINES, PENALTIES, LOSS OF REVENUE OR BUSINESS OR LIABILITIES THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE WEBSITE, OR WHICH ARISE FROM SITES ACCESSED THROUGH THE WEBSITE, AND/OR CONTENT OR INFORMATION PROVIDED ON OR THROUGH THE WEBSITE. 

BY USING OR ACCESSING THE WEBSITE, YOU ACKNOWLEDGE AND AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE WEBSITE IS TO STOP USING THE WEBSITE.  

IF THE FOREGOING LIMITATIONS ARE DISALLOWED, IN ANY EVENT, THE TOTAL LIABILITY FOR MARY’S CENTER SHALL BE $100.00.  

VIII.        Acceptable use and indemnification from improper use 

You agree to indemnify, hold harmless and defend (collectively “indemnify” of the similar term as the context so requires) Mary’s Center from and against any damages, costs, losses, liabilities, claims, causes of action, proceedings, lawsuits, and expenses (collectively “Claims”), including attorneys’ fees, costs, and expenses reasonably incurred by Mary’s Center in connection with, related to, or arising out of your access, use or interaction occurring through the Website or the content made available via the Website.  

IX.        These Terms Of Use are governed by the law of Washington, D.C.  

·     These Terms of Use shall be governed by and construed by the laws of Washington, D.C., excluding its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these, and you further agree and submit to the exercise of personal jurisdiction of such courts to litigate any such claim or action. The Website is designed for and intended for use only in the United States. By using the Website, you explicitly consent that all applicable United States laws, including those that pertain to data privacy, apply to your use of the Website. If you are in a jurisdiction that either restricts you from accessing the Website or limits the effect of the provisions of these Terms of Use. 

X.        Patient Portal  

Mary’s Center may make available a patient portal to you. Access to the patient portal may be subject to further terms and conditions accessible through the patient portal.  

XI.        Your personal medical information  

Please note that except where expressly stated otherwise (such as certain Third Party Pages or Third Party Websites) there is no provider–patient relationship between you and Mary’s Center solely resulting from your use of the general Website.  Except where expressly stated otherwise, any information you share on the Website is not protected under confidentiality laws that protect provider–patient communications.  By posting information to the Website, you are sharing your personal information. Please carefully select what you choose to disclose and do not share personal medical information. 

XII.        You grant a license to Mary’s Center for all submissions  

You grant Mary’s Center a non-exclusive, worldwide, royalty-free, perpetual license, with the right to sublicense, reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform any materials and other information (including, without limitation, ideas contained therein for new or improved products or services) you submit to public areas of the Website by all means and in any media now known or hereafter developed (“Submissions”). You waive all rights to such Submissions and warrant that you have the right to any Submissions. You agree that you shall have no recourse against Mary’s Center for any alleged or actual infringement or misappropriation of any proprietary right in your communication to Mary’s Center. 

XIII.        We will comply with the Digital Millennium Copyright Act   

If you have any copyright concerns about materials posted on the Website, you agree to let Mary’s Center know. Under Title 17, United States Code, Section 512(C)(2), notifications of claimed copyright infringement should be sent to Mary’s Center’s Designated Agent. An effective notification contains the following: 

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. 
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online website are covered by a single notification, a representative list of such works at that website. 
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.

What personal data do we collect and why do we collect it

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

If you leave a comment on our site you may opt-in to saving your name, email address, and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

Analytics

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights do you have over your data?

If you have an account on this site or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.
